Terms of Business
General Terms and Conditions of Business of GymBeam s.r.o.
I. Basic Provisions
These General Terms and Conditions regulate the relationship between the parties to the sales contract, one of which is GymBeam s.r.o. ID No. 46 440 224, with its registered office at Rastislavova 93, 040 01 Košice, Slovak Republic, registered in the Commercial Register of the District Court Košice I, Section: Sro, File No. 35719/V as the Seller (hereinafter "Seller"), and the other party is the Buyer, who may also be a consumer (hereinafter "Buyer"). Further information about the Seller is available at www.gymbeam.hr in the section "Contact".
Buyer is a consumer or an entrepreneur.
Consumer is a natural person who does not act within the scope of their business or other entrepreneurial activities when concluding and performing the sales contract.
The legal relationship between the Seller and the Consumer, which is not explicitly regulated by these Terms and Conditions, is governed by the relevant provisions of Act No. 40/1964 Coll., the Civil Code, as well as related regulations.
Entrepreneur is:
- a person registered in the Commercial Register,
- a person operating on the basis of a trade license,
- a person operating on the basis of a free license according to special regulations,
- a person engaged in agricultural activities and registered by a special regulation.
Entrepreneur, for the purposes of these Terms and Conditions, is one who acts in their business activities in accordance with the preceding sentence. If the Buyer states their company ID number (OIB) in the order, they acknowledge that the rules for entrepreneurs stated in these Terms and Conditions apply to them.
The legal relationship between the Seller and the Buyer who is an entrepreneur, which is not explicitly regulated by these Terms and Conditions or by the contract between the Seller and the Buyer, is governed by the relevant provisions of Act No. 513/1991 Coll., the Commercial Code as amended, as well as related regulations. In case of any conflict between the conditions of these Terms and Conditions and an individual contract, the conditions of the contract prevail.
By creating an order, the Buyer confirms that they have familiarized themselves with these Terms and Conditions, of which the "Complaint Procedure" and "Delivery" are an integral part, with the conditions of the ordered service and/or license, and accepts them at the valid and effective moment of sending the order.
The Buyer is aware that by purchasing products found in the Seller's business offer, they have no right to use the registered trademarks, trade names, corporate logos, or patents of the Seller or other companies, unless otherwise agreed by an individual contract in a specific case.
II. Sales Contract
1. Conclusion of the sales contract
If the Buyer is a consumer, the proposal to conclude a sales contract is the placement of offered products by the Seller on the website, whereby the sales contract becomes valid after the order is placed by the Buyer/consumer and received by the Seller. The Seller will then confirm the receipt of the order to the Buyer without delay via notification to the indicated email address; however, this notification does not affect the contract. The contract (including the agreed price) can only be changed or cancelled by agreement of the parties or on the basis of justified reasons. For an exception to this procedure, see point VI. Ordering.
If the Buyer is an entrepreneur, the proposal to conclude a sales contract is the order for products submitted by the Buyer who is an entrepreneur, and the sales contract is valid from the moment of delivery of the binding order confirmation by the Seller to the entrepreneur. The Seller is not liable for any errors in data transmission. The contract is concluded in the Croatian language.
The concluded contract is archived by the Seller for at least five years from its conclusion or for the longest period in accordance with relevant legislation, for the purpose of its successful fulfillment, and is not available to third parties. Data on individual technical steps leading to the conclusion of the contract are obvious in these business terms where the procedure is clearly described. The Buyer has the opportunity to check and, if necessary, correct them before submitting the order. These General Terms and Conditions are available on the Seller's individual portals so that the Buyer can archive and reproduce them.
The costs that the Buyer incurs when using remote communication systems (telephone, internet, etc.) for ordering are in the amount that depends on the tariffs of telecommunication services.
If the Buyer/consumer orders any service, they agree that these services will be provided to them before the expiration of the statutory withdrawal period.
2. Delivery of the subject of purchase
By the sales contract, the Seller undertakes to deliver the product to the Buyer, ensure the digital content/license of the subject being purchased, and enable them to acquire ownership/license rights, while the Buyer undertakes to take over the product/digital content and pay the Seller the purchase price.
The Seller retains ownership of the product, and therefore the Buyer becomes the owner only after the full purchase price has been paid. This rule applies equally to the purchase of a license or service.
The Seller will deliver the product and documents related to it and will enable the Buyer to acquire ownership/license rights in accordance with the contract.
The Seller will fulfill the obligation to deliver the product to the Buyer if the Buyer allows the loading of the product at the place of execution and notifies them thereof in a timely manner.
If the Seller must send the product, they will deliver it to the Buyer – entrepreneur by handing over the product to the first carrier and will enable the Buyer to claim transport rights from the contract in relation to the carrier; the Seller will deliver the product to the Buyer – consumer only when the carrier delivers the products.
The Seller will deliver the subject of purchase to the Buyer in the specified quantity, quality, and design.
If it is not specified how the product will be packaged, the Seller packages it in accordance with common practice; if this is not common practice, the product must be packaged to preserve and protect it. Similarly, the Seller will package the product for transport.
Taking into account the reduction of damage and ensuring trouble-free delivery, the Seller reserves the right to deliver the product to the Buyer who, within one order and/or one day, orders products with a total value greater than 3500 € including VAT, only after payment of the full purchase price. As soon as the Buyer pays the full purchase price of the purchased products, the Seller will deliver the shipment in accordance with the Buyer's requirements stated in the order.
III. Security and Data Protection
The Seller hereby notifies the Buyer that, in accordance with Section § 10, Article 3 b) of Act No. 122/2013 Coll. on the procedure for the protection of personal data, they will process the Buyer's personal data without their consent as a data subject in the procedure of concluding a sales contract, since the Seller will process the Buyer's personal data in pre-contractual relations with the Buyer, and the processing of the Buyer's personal data is necessary for the performance of the sales contract in which the Buyer is one of the parties.

The Buyer, based on a free written request, has the right to object to the processing of personal data in cases from Section 10, Article 3 (a), (e), (f), or (g) of Act 122/2013 Coll. stating reasons or providing evidence of unauthorized interference in their rights and protected interests that are or may be violated, unless any legal reason prevents this, and if the Buyer's objection is justified, the Seller is obliged to cease using and disposing of the Buyer's personal data to which objection was made, without unnecessary delay.

All prices are contractual. Online stores always contain up-to-date and valid prices. Prices are final, i.e., they include VAT and all other taxes and fees that the consumer must pay to receive the product, and this does not apply to any transport costs, etc.
Promotional prices are valid until the expiration of the stock of a certain number of products or for a certain period of time.
The Original Price denotes the price of the product/service/license offered by GymBeam, not taking into account the total amount of possible bonuses, marketing campaigns to support sales, and other promotions with discounts in its e-commerce store.
VI. Ordering
The Buyer will receive products at the price valid at the time of the order. The Buyer has the opportunity to familiarize themselves with the total price, including VAT and all other costs before ordering. This price must be stated in the order and in the order receipt confirmation. The Buyer has the opportunity to familiarize themselves with the validity of the offer or price before sending the order.
Ordering can be done in the following ways:
• in the GymBeam.hr e-commerce store
The Buyer acknowledges the fact that there may be cases where the contract will not be concluded between the Seller and the Buyer, especially when the Buyer orders products at a price that is incorrectly stated due to an error in the Seller's internal information system. In this case, the Seller notifies the Buyer thereof and has the right to withdraw from the contract.
The Seller reserves the right to declare the sales contract invalid in case of improper use of personal data, credit card payment, etc., or due to interference by an administrative or judicial body. The Buyer will be notified of this procedure.
The Buyer acknowledges that in these cases the sales contract cannot be concluded.
The Buyer will receive the product (product, service, license) at the price valid at the time of the order.
VII. Withdrawal from the Contract
Withdrawal from the contract by the Buyer who is a consumer
In accordance with Section 7 of the Consumer Protection Act, when selling products or providing services based on a contract concluded via remote communication outside the Seller's premises and when amending certain laws (Act No. 102/2014 Coll.), the Buyer has the right to withdraw from the contract without stating reasons within 14 days from the day of receipt of the product or from the conclusion of the service contract, but it is necessary to send a letter or email to the Seller regarding the withdrawal from the contract.
Please send the notice of withdrawal and the products to the address:
GymBeam, s.r.o.
Rastislavova 93
040 01 Košice, Slovak Republic
Download the withdrawal form by clicking on this link.
The Buyer has the right during this period to unpack and test the products in a manner similar to buying in a classic store to the extent necessary to assess the nature, characteristics, and functionality of the product. The Buyer must return the products with complete, full documentation, undamaged, clean, if possible in the original packaging, in good condition and of the same value. The consumer is responsible for the reduction in the value of the product resulting from handling the product that is beyond the necessary procedure for assessing the characteristics and functionality of the product. The consumer is not responsible for the reduced value of the product if the Seller has not fulfilled their obligation to provide information about the consumer's right to withdraw from the contract in accordance with § 3 Section 1 h) of the Consumer Protection Act in sales via remote communication.
If the products are intact, including the original packaging, undamaged, and have no signs of use, the Seller will extend the aforementioned 14-day period for returning the products by 30 calendar days from the date of receipt of the product.
In accordance with the aforementioned law, and given the nature of the range of products sold, products sold in the FOOD SUPPLEMENTS and PROTEINS section cannot be returned if the products have been unpacked, used, or have any signs of use.
Money for returned products is returned to the Buyer within 14 days of delivery of the notice of withdrawal from the purchase contract.
Except in cases where withdrawal is agreed, the consumer cannot withdraw from the contract:
a) for the provision of a service in which the provision of the service has begun with the express consent of the consumer, and the consumer has declared that they are appropriately informed that, by declaring such consent, they lose the right to withdraw from the contract after the provision of the complete service, and
b) sale of products or provision of services whose price depends on changes in stock market prices that the Seller cannot influence and which may occur during the expiration of the withdrawal period,
c) sale of products made according to specific consumer requirements or products specifically intended for an individual consumer,
d) sale of products subject to rapid deterioration or destruction of quality,
e) sale of products contained in protective packaging that is not suitable for return for health or hygiene reasons and whose protective packaging has been damaged after delivery,
f) sale of products that, due to their nature, can be mixed with other products after delivery,
g) performing urgent repairs or maintenance, which the consumer has expressly requested from the Seller; this does not apply to service contracts and contracts for the sale of other products as parts necessary for repair or maintenance, in case they were concluded during the Seller's visit to the consumer and the consumer did not order these services or products in advance,
h) sale of recordings, images, sound, and image recordings, books, or computer software sold in protective packaging, if the consumer has unpacked the packaging,
) sale of periodicals, with the exception of sales under a subscription contract and sales of books that are not secured in protective packaging,k) provision of accommodation services not for accommodation purposes, transport of products, car rental, provision of catering services, or provision of services related to leisure activities under which the Seller undertakes to provide these services at an agreed time or within an agreed period,
l) for the provision of electronic content that is not on a physical device, in case its provision was initiated with the express consent of the consumer and the consumer has declared that they are appropriately informed of the loss of the right to withdraw from the contract by declaring such consent.
If the Buyer decides to withdraw within the stated period, it is recommended to deliver the products to the Seller's return address with an attached letter, stating the reason for withdrawal from the sales contract (not a condition), the purchase invoice number, and the bank account number, and the decision on whether the amount will be paid in cash or will be used for the next purchase.
The Buyer acknowledges that in case of withdrawal from the contract, they will cover the costs of returning the products to the Seller, and in case of withdrawal from a contract concluded via remote communication, they will cover the costs of returning products that, due to their nature, cannot be returned by mail.
The Buyer acknowledges the fact that if gifts are given with the products, the gift contract between the Seller and the Buyer is concluded under the condition that, if the consumer's right to withdraw from the contract is exercised, the gift contract will lose its validity and the Buyer will be obliged to return the products with the accompanying gifts. In case they are not returned, these values will be considered as unjust enrichment of the Buyer's assets.
In case all the above conditions for returning the products are met, the Buyer will have the right to a refund for the paid products, which will be returned to the Buyer no later than 14 days from withdrawal. The Seller is obliged to return the purchase price to the Buyer in the same way as the Buyer made the payment, unless the Buyer agrees to another method of refund without additional costs for the Buyer.
Withdrawal from the contract by the Buyer who is an entrepreneur
If the Buyer is an entrepreneur, a substitute withdrawal from the sales contract may be offered to them, depending on the condition of the returned products, warranties, and the actual price of the returned products. The condition of the products is assessed by the Seller. In case of a lack of agreement on conditions acceptable to both parties, the products are returned at the Seller's expense. The Seller has the right to charge the Buyer for all additional costs incurred.
To protect the rights of the Buyer, if the Buyer is a legal entity and if they request a refund by paying a credit approval directly in the store, the corresponding amount will be paid only to individuals authorized to act on behalf of the relevant legal entity, the legal body, or a person who shows an officially certified power of attorney.
Reviews go through an automatic approval process that checks and publishes them in accordance with guidelines for user reviews.
